6. For an investigator, e.g. Investigations and Enforcement or SWAT team members, ask if they have a court order or search warrant.
Just a note, the Environmental SWAT Team does not exist anymore, although there is the Sector Compliance Branch that is somewhat similar. Also, officers of the old SWAT Team and/or the Sector Compliance Branch are inspectors, not investigators, and can therefore use the inspection powers of the Environmental Protection Act – they do not use or need warrants. Just in case you think about slamming the door on them!

Collectively the uncontrolled discharge from private Onsite Wastewater Treatment Systems will become the largest contributor of PHARMA to the environment. The Great Lakes Clean Water – L.P., a group of inventors and investors dedicated to the preservation of source water in the Great Lakes, has developed the WATERCLEAN™ Advanced Oxidation Technology which, among other things, reduces PHARMA onsite. As you are no doubt aware, we have a daily intake of compounds of emerging concern, including cancer causing disinfection by-products, volatile organic compounds, and pharmaceuticals from our municipal product vendor. i hope you didnt mind i sent several fax(s) of interesting news paper clippings i thought that would be of interest water and lanfill
I have a problem with protecting a line of century maples/ oaks etc. A 10mw solar energy field is planned for the land right next to my fence . My trees will be approximately 15 to 20 feet from where they will drill thousands of boreholes to anchor solar panels. there will also be heavy trucks and machinery driving over immediate area on the other side of the fence. The Energy Co. actually came to my house and asked us to cut them down. These trees are beautiful and I don,t know what to do. Can you tell me where to start?

You could consult a qualified tree expert for advice on how to help the trees survive the holes and the traffic. You could also try approaching the head of the energy company to see if they will install their panels without unnecessarily damaging the trees.

First, I would like to say hello and that I thoroughly enjoy perusing your site. My name is Sara and I am currently attending the Humber north campus for their Law Clerk program. It is an excellent course, but has more focus on business and criminal law, whereas my true interest is in environmental studies. I understand that all law flows and ties together, but it lacks focus on some particular areas. I am doing quite well in the program and have been wondering how I can merge my interests and enter into a field such as yours. What type of schooling did you have to complete to get into this field? I am still looking to become a law clerk, however, would you be willing to give me a couple suggestions of paths, programs or courses I should take to better my chances of entering into environmental law? I have a question about the article you wrote about "Where are Electronic documents for Hazardous Wastes". It says that "Under section 23, waste generators must also retain Copy 2 (Green) of each waste manifest for at least two years at the head office and retain an electronic copy of the manifest at the waste generation facility." I would like some clarifiaction on this if possible. If Company ABC has a head office in Calgary, but has a locations in London, Toronto and Hamilton Ontario(not remote or satilite locations) does that mean all the manifest copy 2's (green copy) must be filed at the Calgary head office and only photocopies/scanned in copies of the manifests are filed at the coresponding facilities?

Nothing in the regulation specifically allows the Ontario sites to satisfy their obligations using photocopies, but neither am I aware of anyone having been prosecuted for keeping photocopies rather than the original or scans.

Dear Diane,
I live in County of Brant -Paris ON. The County sold land that was a burme between Resid & Lt Indust zoning to Custom Home Developer who built houses. We live in one. Our back property and “mini mall” 50 ft behind us share same property line. It is zoned Lt Indus which included “learning/teaching centre” – which no further in depth definition. A “DANCE” studio has rented the whole back 3 units. All we hear is thumping and booming of base speakers. The mall units are not R insulated for sound and to make things worse the tenant opens the back door(s) and it blares right at our home. Their elevation is higher than our back yard and the sound travels right at our living level. We and our neighbour next to us had a meeting with the County Planner, the Bylaw Officer and my Council Rep. They said they can only ASK the Mall Owner to ASK the tenant to keep the door closed. The business operates evenings ’til 9m-? and weekends Sat/Sun when we are home trying to enjoy our home and backyard. We are besides ourselves and don’t know what to do??? Isn’t Resid zoning “sensitive” 24/7. We feel horrible our own town won’t help us. We lived here before the Dance Studio rented the space. Is there something we can legally do about the immediate nusance noise (tenant) and take then action regarding the renting of the unit to any other future “sound based” businesses. This “teaching/learning ctre” is not a quiet classrom based environment. PLEASEEE there must be something!! My spouse Larry says he “feels his heart” thumping when she is playing her “music”. It comes thru our walls right into our house. We have to turn the TV up. (how crazy) And turning up our outside Music and blasting it so we don’t hear hers is disrespectful to our next door neighbours in their homes. I feel like crying when I talk about it… It is stressing us out. We love our home and don’t want to move…

Dear Jane,
Unfortunately, if the municipality won’t act, and direct discussions with the tenant don’t help, there may not be a free, effective solution. You could try renting a sound meter, and taking good measurements for a few weeks, before going back to your municipal councillor for help. You could consider a small claims court action against the landlord and tenant, or consult a knowledgeable lawyer to assist you.
