Procedural skirmishing is underway in the Hanna lawsuit against Ontario wind turbines.
Hanna is seeking a declaration striking down certain sections of O.Reg. 359/09 that could authorize renewable energy permits for wind farms. He argues that the Environmental Bill of Rights requires the MOE to consider the Ministry Statement of Environmental Values in its decision-making, and that the regulation breaches the precautionary principle because of uncertainty concerning the health effects of wind turbines.
The Canadian Wind Energy Association has been permitted to intervene in the case as a friend of the Court, but not as a party. Also, certain of Hanna’s supporting affidavit material has been struck out. Otherwise, the case continues to grind on. I still don’t think it has any chance of winning, but Hanna may be able to frighten some potential investors.

I suppose Dianne Saxe doesn't have have wind turbines being built near where she lives(yet). I live near Ripley Ontario and will be affected by the Bluewater wind project. I will have several massive GE turbines in close proximety to my old farmhouse with the nearest 550 metres away which is the minimum setback. The wind company says my home will be at the 40db level but could not tell me what frequency or frequencies of sound make up that 40db. One factor completely overlooked is that the clay soil we are on transmits and often amplifies ground vibration. If those large rotating masses are not balanced perfectly, the effect will be felt for a very large distance away, much more than 550metres. I am very disappointed in my neighbours who signed up for turbines, but not surprized. We need a new government that can once again act as a concience for those that don't have one, otherwise greed rules. By the way, I moved here 23 years ago for peace and quiet. in Montreal Gazette 08-13 2010 business section is a report that Quebec Hydro has agreed to sell hydro to state Of Vermont, 26 year contract , at a reported price of 6 cents
a kilowatt hr.
yet it is reported that installers of wind turbines will be payed 58 cents a kilowatt hr
what gives?

Hi Fred the mills are to the south of me and soon to the north ,and surround my place here. , I have ringing of the ears bad bad when wind is from the south , That along with head aches and dizzy , ,. NOW I am NOT making this up because of what I read or heard . I LIVE IT . I think that 10 or more years from now ,people are going to step back and say WHAT HAVE WE DONE !!!!!!!!!!!!!!!
It's rather curious that the industry trade organization, CANWEA, seeks a relationship with the MOE. Is not the MOE charged with protecting citizens? – not very good optics.
You fail to note that the MOE lawyers based their case arguments on having Dr. Robert McNurtry disqualified as an expert witness on the issues, which request the justice sensibly refused to accept. Well, it was worth a try if you haven't anything better.
Dr. Robert McCunney (one of the panel authors of the CANWEA/AWEA report on health issues and wind turbines, said:
"There's no question that some people may be very annoyed and adversley affected by the sound and the characteristics of the sound. There's no question that annoyance can causer sleep disturbance. There's no question that if sleep disturbance persists it can cause health effectsand all sorts of consequences. However, I am struggling to understand how the noise from wind turbines is substantially different from other aspects of life, whether its's trucking, transportation, railroading, aviation and so forth. That's where I draw the line." – and this is his rationale for not doing an epidemiological study??? – the MOE lawyers must be tearing their hair out to find expert, medical witnesses who can present unambiguous, persusive arguments.
The professional and administrative class in this province have failed to properly assess the risks of industrial wind turbines. They have whole-heartedly accepted whatever statements the industry has made. – no sbstantiation required. Further, it is likely the new protocols for measuring noise will remain deficient attempts to make the noise data fit the protocol. They have better standards in Alberta that at least try to delineate situations where low frequency noise is excessive.
The cynicism of this govt. fuels a quiet despair in the rural areas. People are fearful and angry. Wind salesmen are not happily received. Talk to the people who will be affected. That's why the Ian Hanna lawsuit has drawn broad resonates out here. We support it.
i live in ontario melancthon township dufferin county and i have been affected by the wind turbines for the past 3 years i have headaches i have went on medication for dipression and if i miss taking my meds one day i will not be able to sleep even taking the meds the turbines can still affect my sleep life has been terrible living here since the turbines have been constructed now some of my neighbors are trying to sell there homes where as i dont think it is fair to sell my problem home to some innocent family i have 40 stop the turbine signs on my front lawn and on my house now i believe the owners of these terrible nightmare turbines should be responsible to help us residents that have been so affected by there lack of concern for all residents of ontario yours trully Brent Green
I live in rural South Texas and am in the third week of operation of the turbines placed approximately 1500' from my home. I went from a peaceful and tranquil environment to what feels like the end of an airport runway. As I type this message, the noise from outside is making my blood pressure rise! I fear I will have to move and abandon a property I've spent heavily on to develop for a retriever training facility. My complaints are answered with the typical corporate response. Currently looking for a good attorney!
