If i buy land that has been contaminated from the 50s, am i responible for the clean up or can i rezone it to commercial and run my business from it. There is an existing building that would need work also.

Hi, Ted,
It’s complicated. The analysis includes questions like: is there an actual conflict between the applicable federal and provincial laws? Is the provincial law intrinsically valid? Is it, in its pith and substance”, unduly intrusive into federal jurisdiction? For particular questions, there may also be relevant precedents. As always, if you need a legal opinion for a specific problem, please consult a qualified lawyer.
Best wishes.

They can certainly overlap. The simple answer is that agricultural regulation focuses on farmers, and is generally implemented by the Ministry of Agriculture; environmental regulation focuses on environmental impact and is generally implemented by the Ministry of Environment.
I hope that helps

Thanks Dianne for writing the summary. I'm an environmentalist in Florida and while browsing the net, I accidentally stumble in your blog. I was amazed by how you summed-up all the information about Canada's Environmental law. Maybe I should do the same. =)

Hi Dianne,

What do you see as the most important recent and upcoming policies and legislation on the environmental front - including related initiatives dealing with the economy moving to more sustainable practices? Also, second question - do you think the Feds will carry through on their pledge and enact Rouge Valley as a National Park soon?

We are a federal country, with lots of jurisdictional overlap in many areas.

The Canadian Environmental Assessment Act deals with environmental evaluations before certain kinds of projects are built. The Canadian Environmental Protection Act covers many more topics that affect ongoing activities and pollution, such as long range transport of air pollution, toxic substances, etc.

An excellent summary, indeed! It's great to see such a comprehensive overview of how all the pieces of legislation fit together, all in one document. You always provide a clear explanation of how case law fits into, enhances, and fills in the gaps in the legislative matrix set out in statute law.
Thanks again,
Michael F.
