Living at in London. We have been told that the maple tree situated close to our property line adjacent to our drive way is on the property of our neighbors . This information was given by phone direct from the City of London - Tree Dept. The roots from the tree are uplifting our driveway and lessening the passageway & our neighbors refuse to do anything about it except say to cut the roots and pave over. We have read 'Trees & the laws in Canada' - Julian Dunster and it seems clear on our rights as neighbors. The questions I have are;
1. What is the easiest way we can ascertain the tree is on my neighbor's property without undergoing a complete survey?
2. Is this 'common law' resolution or is it an item that can be settled by the by-laws in the city of London or is it a provincial matter?
Thanks for your support
